Nevada's Department of Health and Human Services, Aging and Disability Services Division administers the Assisted Living (AL) waiver. This state-sponsored waiver program provides assisted living support services within an assisted living facility. Services provided under this waiver may include assistance with activities of daily living, such as grooming, bathing, eating and dressing.
To be eligible for enrollment, seniors must be aged 65 or older and at risk of placement in a nursing facility. Seniors must also meet the admission requirements for placement in an assisted living facility that receives the Nevada Low-Income Housing Tax Credit.

Low-income Nevada seniors aged 65 and older who need the level of care normally provided in a nursing home may qualify for enrollment in the Home and Community Based Waiver program. Administered by Nevada's Aging and Disability Services Division, this Medicaid waiver is open to seniors who earn no more than $2,349 per month and have countable assets of $2,000 or less.
While the waiver does not cover room and board costs, it does cover the following services for seniors who reside in an assisted living facility:
- Personal care, including help with activities of daily living
- Homemaker services
- Adult day care for four or more hours daily for one or more days each week
- Nonmedical companion care
- Respite care
- A personal emergency response device

The U.S. Department of Veterans Affairs' VA Aid and Attendance administers two VA pension top-up programs for qualified veterans, their dependents and eligible survivors. These programs are known as the Aid and Attendance benefit and the Housebound allowance. These programs provide enhanced VA pension benefits that can be used towards assisted living costs in Nevada. To qualify, applicants must be eligible for the regular VA pension and meet specific program requirements.
For Housebound, applicants must meet one of the following requirements:
- Have one permanent disability that is rated at 100% according to VA standards, and be largely housebound as a result of that disability
- Have one disability rated at 100% by the VA and one or more additional disabilities rated at 60% or more
For Aid and Attendance, applicants must:
- Need assistance from a caregiver to perform one or more activities of daily living, including eating, dressing, bathing, toileting and moving around their home
- Be a full-time resident in a nursing home as a result of physical and/or cognitive decline
- Have a severe, permanent visual impairment
- Be restricted to bed as a result of a chronic illness or disability
Nevada Assisted Living Rules and Regulations
Assisted living facilities in Nevada are regulated by the state. The Department of Health and Human Services, Division of Public and Behavioral Health oversees the licensing and inspection of all health facilities in the state.
Scope of Care | Assisted living facilities provide 24/7 protective supervision, personal care services, housekeeping and laundry and at least 10 hours of weekly recreational and social programming. ALFs also give residents access to dental and vision care, as well as other medical services as required, but ALFs do not offer around-the-clock skilled nursing care. Facilities that are approved to provide dementia care must also offer activities that promote sensory enhancement, gross motor skill maintenance and outdoor activities in a way that protects residents against wandering. Facilities may not admit residents who are completely bedridden or who require 24-hour skilled nursing, except when enrolled in a hospice program and with an exemption from the licensing body. ALFs are also unable to admit or retain residents who require physical restraints or who need skilled nursing care to manage oxygen treatment, catheterization or an ostomy/urostomy. |
Care Plan Requirements | Facility administrators must ensure every resident has an up-to-date needs assessment and that the identified needs are being met. |
Medication Management Requirements | Residents who are able to self-administer medications are allowed to do so. Unlicensed staff can also administer prescription medications upon successfully completing an approved 16-hour medication training program and maintaining their certification with at least eight hours of annual training. Administrators in facilities where unlicensed staff are trained to administer medications must also complete 16 hours of initial medication management training and at least eight hours of annual ongoing training. ALFs can only provide assistance with injection medications if the drugs are administered by a licensed medical professional, such as a physician, registered nurse or licensed practical nurse. |
Staff Requirements | There are no minimum staffing ratios in Nevada, but facilities are expected to have enough staff on-site to maintain a safe environment for residents. At least one awake staff needs to be in the facility at all times, and facilities with between 20 and 49 residents must have a staff member assigned to organize recreational programming. Larger facilities must employ a full-time recreation programmer. |
Staff Training Requirements | Within 60 days of being hired, all ALF staff must complete at least four hours of training covering emergency procedures, and every staff member needs to complete at least eight hours of in-service training annually. All caregivers must become certified in first aid and CPR within 30 days of being hired. A criminal record check is required for all new hires within 10 days of commencing work at an ALF. Caregivers who have prior convictions for abuse, neglect or other crimes that could negatively impact vulnerable persons are ineligible for employment at a licensed assisted living facility. |
Medicaid Coverage | Nevada Medicaid covers the cost of care in an ALF for seniors enrolled in the Medicaid Home and Community Based waiver. Seniors are responsible for the room and board portion of their care costs. Although the state doesn't cap what providers can charge for room and board, residents must be allowed to retain at least $110 each month as a personal needs allowance. |
Reporting Abuse | By law, Nevada's Aging and Disability Service Division is responsible for collecting and investigating reports of elder abuse, neglect and exploitation, which includes seniors residing in assisted living facilities. Anyone who suspects that a vulnerable adult or senior is a victim of a crime must file a report with the ADSD or a local law enforcement agency. State Health Insurance Assistance Program
Nevada's SHIP provides free information, unbiased counseling and advocacy to those who are either currently enrolled in Medicare or about to enroll. Trained and vetted SHIP volunteer counselors schedule one-to-one appointments with seniors and their family members, conduct public education sessions and make referrals to other resources and community services when needed.

Area Agencies on Aging in Nevada
Nevada's Aging and Disability Services Division serves as the state Area Agency for Aging. The division oversees a number of programs and services for seniors and other vulnerable populations, advocates for state and federal funding for seniors and works to help older adults retain their independence as they age.

Veterans Affairs Offices in Nevada
The U.S. Department of Veterans Affairs administers a number of programs for veterans, survivors and dependents. The U.S. Social Security Administration operates the nationwide Supplemental Security Income program, a monthly cash benefit for qualified low-income seniors and adults living with certain permanent disabilities.
